Filing For Chapter 7 Bankruptcy In Desoto, Texas

The purpose of bankruptcy is to give consumers a fresh start by setting them free from economic bondage.

Do you live in Desoto, Texas and feel that it is impossible for you to move ahead financially? Do you find yourself unable to cope with the unceasing flow of threats, insults and harassment by bill collectors because of your unpaid debts?

If you answered yes to any of the above questions, then you could use help from a qualified, experienced bankruptcy attorney.

That attorney is the law firm of Allmand and Lee.

Wipe Out Your Unsecured Debts Completely

When faced with financial insolvency, most people think of a chapter7 bankruptcy. Why? Because when you file for debt relief under chapter 7, all your dischargeable debts are wiped out completely.

In many cases, you will be able to retain all your possessions. The United States Supreme Court has expressed that bankruptcy is intended to free honest debtors from the indebtedness that has become burdensome and oppressive.

As a consumer, you have the right to a fresh start in life, to live in a state of relief from the financial obligations and responsibilities that may have been the result of bad luck or circumstances beyond your control.

Hiring a Bankruptcy Attorney to File a Petition

At Allmand and Lee, we do not charge anything for the initial consultation. We will listen patiently to you and examine and discuss your particular financial situation.

If we find that a chapter 7 bankruptcy is most appropriate to your individual situation, you sign a retention agreement with us. You will be given forms and other papers that need to be filled out. There will also be a checklist for the documents required for us to initiate the bankruptcy process, such as pay stubs and tax returns.

The next meeting with us as your bankruptcy attorney is generally scheduled after a week or so to check if all forms have been filled out properly and other documentation is completed.

After reviewing all the documents, you will need to sign the bankruptcy petition, which will we will file with the court. All your creditors will also need to be served with notices, which we will do on your behalf.

When you hire Allmand and Lee as your bankruptcy attorneys, we do all the work, freeing you from stress and giving you peace of mind.

After The Filing

The filing and service of notice(s) can take anywhere from a couple of days to a few weeks depending on your situation. Between one to two months of the filing of the bankruptcy petition, a meeting with your creditors will be held at a designated venue where your creditors and a trustee or examiner will question you under oath regarding your financial affairs. This is known as a 341 meeting.

After the 341 meeting, it takes about three months to receive a discharge in a Chapter 7 bankruptcy. Once you are discharged, you do not owe anything to your unsecured creditors that were discharged under the Chapter7 bankruptcy proceedings.
