It&#039;s important to remember that if the debtor dies during the bankruptcy case then someone must be appointed by the bankruptcy court to act as &quot;next friend&quot; and, as such, to testify on behalf of the decedent.  At least in New York, where I practice, the executor of the estate must still be separately qualified to act on the debtor&#039;s behalf in bankruptcy court. </description>
